I was interested in improving my swim skills and was looking for a swim coach that offered private lessons. I was referred to Brandon Wilson by a local community gym/pool facility.

 

On May 13, 2008, I met with Brandon Wilson and performed several water activities to identify skills I needed to imrove. At that time, Mr. Wilson recommended that I sign-up for 11- one hour private swim sessions which cost $420.00 and was paid by Check# 5707. However, once Mr. Wilson had my check and the completed form - he claimed not to have the ability to provide me a copy of the contract at that time but would have a copy for me at the first swim session. However, I never got a copy of the contact but Mr. Wilson cash my check and pocket my money. My first swim session was held on May 20th for an hour; and the second was held on May 29th for 30-minutes because Mr. Wilson had another appointment; but stated he would call me to setup additional sessions on June 1st. I didn't hear from Mr. Wilson again until June 3rd at which time he left me a voice message on my business phone. My return calls to him went unanswered.

 

On June 11, 2008, I made written request to Mr. Wilson canceling the remaining 9 1/2 swim sessions and requested an immediate refund of $350.00 which he failed to honor. As a result, I filed a complaint against AquaAble Swim, LLC and Brandon Wilson, it's owner with BBB on July 2, 2008; and the Maryland Attorney General, Consumer Protection Service on July 7, 2008 for unfair business practices and failure to honor a written request for a refund. Recently (3 months later), I was informed by Consumer Protection Service that Brandon Wilson, owner of AquaAble Swim, LLC said he will not refund the $350.00, and has  refused to submit this dispute to arbitration.

 

It is my hope that potential customers and/or parents who are looking for a private swim coach be made aware of Brandon Wilson, AquaAble Swim, LLC business practices and not patronize his business. Hopefully, Mr. Wilson learns: Refunding advance payments to customers is a part of doing business, and it is the right thing for a honest business owner to do in order to grow a business.
