We hired JaniKing in November 2007 as our janitorial service. We had problems with our last several cleaning companies and were hoping JaniKing would be the company we were looking for. After the first cleaning, performed by a women named Keisha, we had to call and complain because our facility was not cleaned to our satisfaction. After the next week, we sent a certified letter to JaniKing with our complaints. Shortly thereafter, JaniKing switched our cleaning franchisees to LaConda Jackson and DeAndre Walter. After several weeks (and numerous phone calls to the office staff) our floors were still not swept and mopped adequately and the bathrooms we not restocked. After more complaints, in December JaniKing assigned Courtney to clean our building. He did not take out some of our garbage, did not replace items where they were left by ATTS staff and, again, did not sweep and mop adequately. In early January, I called JaniKing and spoke to Carla and informed her that we would be discontinuing their services immediately and asked for our keys and a discounted bill to be sent to our location. I also sent a certified letter the same day as this conversation. She said I would have to speak to her operations manager and I responded that would be fine. I did not speak with the operations manager, Jill, until a week and a half later. Jill was extremely rude and confrontational from the beginning of the conversation. (We have not paid our bill since signing on with them because of their poor performance. This is why we asked for a discounted bill to be sent to us.) We went back and forth about how we hadn't paid but they had not held-up their end of the contract so we are only going to pay part of what they are charging. I asked her to send a bill they felt was fair but she responded that she wouldn't discount our bill. So I told her to send what we owe based on the contract and we would look at it. I also asked for our keys back and told her that if we didn't get them back today (1/25/08) we would call our lawyer because they had total access to our property. At the beginning of the conversation she wouldn't give me an answer about when we would get the keys back. As the conversation progressed she informed me that I could pick them up at the office until I pointed out that it is her responsibility to return them. Then she said she would send them certified mail because (adding as an afterthought) that she had a message that we didn't want anyone affiliated with her company on our property. She also said that she would take us to court and that the contract would stand up in court. (It is necessary to mention that we did not exactly follow the stipulations in the contract for breaking the contract because the contract is very one-sided and because of their non-performance issues. Due to the character limit, I will not go into complete detail but we would be happy to provide a copy of the contract and all efforts we made to correct this problem.) After our conversation, Jill spoke to the owner, Jerry Thurman, and again threatened a lawsuit. Jerry responded that was fine and that we might, in fact, sue them for damage to our property. We have linoleum floors and they look worse now than before JaniKing started. Our new crew spent four hours their first night trying to get whatever they put on the floor off. Apparently, they mixed wax and soap and our floor will have to be professionally stripped and re-waxed because of this. |
